These Terms and Conditions ("Terms") govern your use of the website at ogdenmasonry.com and any services provided by Ogden Concrete & Masonry ("we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
By using this website or contacting us to request services, you confirm that you are at least 18 years of age, have the legal authority to enter into an agreement, and accept these Terms in full. These Terms apply to all visitors, customers, and others who access or use our website or services.
Ogden Concrete & Masonry provides masonry and concrete contractor services to residential and commercial property owners in Ogden, UT and surrounding areas. Services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, and related masonry work.
All services are subject to a written estimate and a signed agreement between Ogden Concrete & Masonry and the customer before work begins. We reserve the right to decline any project at our discretion.
Estimates provided by Ogden Concrete & Masonry are based on an on-site assessment of the project scope at the time of inspection. Estimates are provided in writing and are valid for 30 days from the date of issue unless otherwise noted.
Estimates are not guaranteed final prices. The final cost of a project may change if conditions discovered during the work differ materially from what was visible at the time of the estimate - for example, if hidden structural damage is found once work begins. We will notify you of any significant change before proceeding with work that would increase the cost beyond the original estimate.
Verbal quotes are not binding. Only written, signed estimates constitute a commitment on our part.
Project scheduling is confirmed in writing or by verbal agreement at the time of estimate acceptance. Start dates are estimates and may shift due to weather, material availability, or prior project overruns. We will communicate any changes to your scheduled start date as early as possible.
If you need to cancel or reschedule a project, please notify us at least 48 hours before the scheduled start date. Cancellations made with less than 48 hours notice may result in a rescheduling fee to cover mobilization costs already incurred.
We reserve the right to postpone or cancel a project due to weather conditions that would compromise the quality of the work, including temperatures below the minimum required for proper mortar curing.
Payment terms are specified in the written estimate for each project. In general, a deposit may be required before work begins, with the balance due upon completion. Specific deposit amounts and due dates will be outlined in the project estimate.
We accept payment by cash, check, and major credit cards. Additional processing fees may apply to credit card payments. All invoices are due upon receipt unless other terms are agreed to in writing.
Accounts that remain unpaid beyond 30 days of the invoice date may be subject to a late fee and referred to a collections process. The customer is responsible for any costs incurred in collecting an overdue balance, including reasonable legal fees.
Customers are responsible for ensuring that our crew has safe, unobstructed access to the work area on the scheduled start date. This includes moving vehicles, clearing stored items from around the work zone, and making sure any locked areas that need to be accessed are unlocked before the crew arrives.
Customers are responsible for disclosing any known hazards on the property, including underground utilities not already marked, structural concerns, or access restrictions. Failure to disclose known hazards that result in damage or injury may affect your rights under these Terms.
Ogden Concrete & Masonry warrants that services will be performed in a workmanlike manner consistent with industry standards. Specific warranty terms, if any, will be provided in writing with the project documentation at the time of project completion.
Warranties do not cover damage caused by acts of nature, soil movement beyond normal seasonal variation, seismic events, improper use, customer modifications, or deferred maintenance after project completion.
Except as expressly provided in a written warranty, all services are provided "as is" without any additional warranty of any kind, express or implied.
To the fullest extent permitted by law, Ogden Concrete & Masonry shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of a specific project shall not exceed the total amount paid by the customer for that project. This limitation applies regardless of the form of the action, whether in contract, tort, or otherwise.

You may not reproduce, distribute, or use any content from this website for commercial purposes without our prior written consent.

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the courts of Weber County, Utah.
We reserve the right to update these Terms at any time. When we do, we will post the revised Terms on this page and update the effective date. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
